An online sales contract refers to the agreement between the supplier MPE Elettronica di Pirani M. & C. snc. with registered office at Via Jesina, 3/G 60022 Castelfidardo (AN) ITALY - VAT number 01101620423, and a customer interested in purchasing articles online. The contract is concluded through the customer's use of the e-commerce platform accessible at the address www.mpeaudio.it. The customer may be a natural or legal person purchasing goods and/or services for their own purposes.
Below are the currently applicable sales conditions. Any changes to the sales conditions will be published on the website www.mpeaudio.it and will be considered valid for all purchases made after the publication of the update.
All prices published include the 22% VAT rate and may change at any time without notice.
Orders from abroad - EU countries
For purchases made by individuals not holding a VAT number, residing both in Italian territory and in that of the European Community, the sale price will be subject to 22% VAT.
For purchases made by individuals holding a VAT number, residing in the territory of the European Community excluding Italy, VAT will not be applied as they are considered non-taxable transactions under art. 40 D.L. 331/93.
Orders from abroad - Non-EEA countries
For purchases made by any person not resident in Italian territory and in the European Community, VAT will not be applied as they are considered non-taxable transactions under art. 8 D.P.R. 633/72
All ordered merchandise can be paid for using the online payment methods indicated at the time of purchase.
The currently authorized payment methods are Bank transfer, Credit card, PayPal, Postpay.
The prices displayed on the website are valid for both online orders and in-store pickup.
Mpe Elettronica will deliver the purchased items to customers through trusted express couriers. The shipping address is the one indicated by the customer during registration. In case the requested shipping address differs from the one indicated by the customer for billing, Mpe Elettronica reserves the right to request from the customer the faxed copy of both sides of an identity document and/or other documents suitable for proving the customer's identity and residence. Shipments to post office boxes, mailboxes, and similar addresses will not be made under any circumstances.
ONLY FOR PAYMENTS THROUGH PAYPAL, M.P.E. Elettronica will not ship to addresses different from the PayPal registration address.
Delivery times are considered upon receipt of payment and in any case up to a maximum of 3 working days. The aforementioned delivery times refer to products available in stock at the time of order and for which availability is indicated. In case of immediate unavailability of products (made-to-order products), delivery times may be longer. However, no liability can be attributed to the supplier for delayed or non-delivery attributable to force majeure or unforeseen circumstances.

Mpe Elettronica assumes no responsibility for failures due to force majeure such as accidents, natural phenomena, and other similar events that prevent, in whole or in part, the execution of the contract within the agreed times. Mpe Elettronica will not be liable to any party for damages, losses, and costs incurred as a result of non-performance of the contract due to the aforementioned causes, with the consumer having the right only to the refund of the price paid.
The consumer who, for any reason, is not satisfied with the purchase made, has the right to withdraw from the concluded contract, without any penalty and without specifying the reason, within 14 days from the date of receipt of the goods. The withdrawal must be communicated within the aforementioned period of 14 days by sending a registered letter with acknowledgment of receipt to the following address Via Jesina, 3/G - 60022 Castelfidardo (AN) ITALY or by email to the following address info@mpeaudio.it
Within the above-mentioned period of 14 days, all purchased goods must be returned intact and in their original packaging and any manuals, only after authorization by Mpe Elettronica. The return costs are borne by the customer unless the goods do not conform to the order. In this case, instructions will be given for shipment to an assigned port. Mpe Elettronica will refund the entire amount (SHIPPING COSTS EXCLUDED) paid by the consumer within 7 days from the date of receipt of the goods. However, any restoration costs (withdrawal, packaging, packaging, inspection, reconditioning, etc.), which for audio speakers can range from a minimum of 80.00 euros to a maximum of 800.00 euros, or for damages ascertained to the goods, the cost of which will be assessed on a case-by-case basis. It will be the responsibility of the consumer to promptly provide the bank details for the transfer.
IN CASES WHERE THE GOODS HAVE BEEN USED, TAMPERED WITH, OR DAMAGED, WITHDRAWAL RIGHTS ARE EXCLUDED.
All products are covered by a warranty pursuant to Legislative Decree 2 February 2002 No. 24
The warranty is valid for 24 months for individuals and 12 months for legal entities. The invoice must be requested at the time of purchase. MPE ELETTRONICA undertakes to repair or replace the defective product within the aforementioned period, and any shipping costs will be borne by the customer except for the first 8 days from receipt of the goods. To exercise the warranty right, the customer must provide proof of purchase by showing a copy of the payment receipt. It is also mandatory to keep the original packaging for at least 30 days. Wearable products installed in loudspeakers such as woofers, tweeters, and drivers are not covered by the warranty. MPE ELETTRONICA reserves the right to inspect the defective goods to exclude damage caused by tampering or improper use, and in such cases, they will not be covered by the warranty. Remember, if the products are found to be in perfect working order, all costs incurred will be borne by the customer.
Personal data is collected for the purpose of registering the customer and activating the procedures for the execution of the above described and related necessary communications; this data is processed electronically in compliance with current laws and may only be exhibited upon request by the judicial authority or other authorities authorized by law. The interested party enjoys the rights provided by Legislative Decree 196/2003 (Personal Data Protection Code), namely: to request confirmation from Mpe Elettronica of the existence of their personal data; to know their origin, logic, and purposes of their processing; to obtain their updating, rectification, and integration; to request their deletion, transformation into anonymous form, or blocking in case of unlawful processing; to oppose their processing for legitimate reasons or in case of use of the data for sending advertising material, commercial information, market research, direct sales, and interactive commercial communication. Any dispute relating to the application, execution, interpretation, and violation of purchase contracts concluded online through the website www.mpeaudio.it is subject to Italian jurisdiction. For any dispute between the parties regarding this contract, the court with jurisdiction will be the one in whose district the consumer has his/her residence if located within the territory of the Italian State; for all other customers, it is agreed that any dispute will fall exclusively within the jurisdiction of the Court of Ancona.
